NOAA opens 45-day public comment period on several EOs to review and streamline regulatory processes & reduce regulatory burden

As part of ongoing efforts to implement several of the President's recent Executive Orders, NOAA Fisheries and the National Ocean Service published a joint Federal Register notice on July 6, 2017, for a 45-day public comment period seeking broad input on identifying existing regulations and processes that, among other things, may be outdated, unnecessary, ineffective; inhibit job creation and growth; and /or can be further streamlined in a manner consistent with law. 

The specific Executive Orders are: 

  • E.O.13766, “Expediting Environmental Reviews and Approvals for High Priority Infrastructure Projects”

  • E.O. 13771, “Reducing Regulation and Controlling Regulatory Costs”

  • E.O. 13777, “Enforcing the Regulatory Reform Agenda”

  • E.O. 13783, ‘‘Promoting Energy Independence and Economic Growth”

  • E.O. 13795, “Implementing an America-First Offshore Energy Strategy” 

NOAA is seeking public comment on the efficiency and effectiveness of current regulatory processes under the following laws:

  • National Marine Sanctuaries Act (NMSA)

  • Coastal Zone Management Act (CZMA)

  • Marine Mammal Protection Act (MMPA)

  • Endangered Species Act (ESA)

  • Magnuson-Stevens Fishery Conservation and Management Act (MSA)

  • Federal Power Act

NOAA is issuing a single request for comment on NOAA Fisheries’ and NOS’ regulations and regulatory processes to ensure the public has the opportunity to comment in a coordinated fashion and does not have to respond to multiple requests for comment.
